Equine Activity Release and Hold Harmless Agreement. The undersigned have read and understand, and freely and voluntarily enter into this Release and Hold Harmless Agreement with Cathy’s Corral, understanding that this Release and Hold Harmless Agreement is a waiver of any and all liability(ies). 2. I understand the potential dangers that I could incur in mounting, riding, walking, boarding, feeding said horse; including, but not limited to, any interactions with other horses, dogs and farm equipment. Understanding those risks I hereby release that Company, its officers, directors, shareholders, employees and anyone else directly or indirectly connected with that Company from any liability whatsoever in the event of injury or damage of any nature (or perhaps even death) to me or anyone else caused by or incidental to my electing to mount and ride a horse owned or operated by The Minix family, coworkers and friends. 4. I understand and recognize and warrant that this Release and Hold Harmless Agreement, is being voluntarily and intentionally signed and agreed to, and that in signing this Release and Hold Harmless Agreement I know and understand that this Release and Hold Harmless Agreement may further limit the liability of equine professionals to include any activity, whatsoever, involving an equine, including death, personal injury and/or damage to property. 5. I recognize and agree that I know which equine professional(s) I will be working with, and acknowledge that I agree said equine professional(s) has/have made reasonable and prudent efforts to determine my ability to engage in the equine activity, and has/have sufficient knowledge of my equine and horseback riding skills as to relieve, release and hold harmless said equine professional(s) from any continuing duty to monitor my equine activities. 6. I further voluntarily agree and warrant to Release and Hold Harmless this (these) equine professional(s) from any liability whatsoever, including, but not limited to, any incident caused by or related to said equine professional’s (s’) negligence, relating to injuries known, unknown, or otherwise not herein disclosed; including, but not limited to, injuries, death or property damage from: mounting; riding; dismounting; walking; grooming; feeding; use of horse barn, paddock, trails or horse ring, in any capacity; falling off horse whether horse is bucking, flipping, spooked; or my failure to understand any equine professional’s directions relating to my riding or otherwise use and control, or lack thereof, of my horse or the horse I have been assigned to. 34-4-44-5. "Inherent risks of equine activities" defined. As used in this chapter, "inherent risks of equine activities" means the dangers or conditions that are an integral part of equine activities, including the following: (1) The propensity of an equine to behave in ways that may result in injury, harm, or death to persons on or around the equine. (2) The unpredictability of an equine's reaction to such things as sound, sudden movement, unfamiliar objects, people, or other animals. (3) Hazards such as surface and subsurface conditions. (4) Collisions with other equines or objects. (5) The potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within the participant's ability. § 34-4-44-6. "Participant" defined. As used in this chapter, "participant" means a person, whether an amateur or a professional, who engages in an equine activity, whether or not a fee is paid to participate in the equine activity. 34-4-44-7. "Person" defined. As used in this chapter, "person" means an individual, an incorporated or unincorporated organization or association, or a group of such persons acting in concert. § 34-4-44-8. Limited liability of equine activity sponsor or equine professional (a) Subject to section 9 [IC 34-4-44-9] of this chapter, an equine activity sponsor or equine professional is not liable for: (1) An injury to a participant; or (2) The death of a participant; resulting from an inherent risk of equine activities. (b) Subject to section 9 of this chapter, a participant or participant's representative may not make a claim against, maintain an action against, or recover from an equine activity sponsor or equine professional for injury, loss, damage, or death of the participant resulting from an inherent risk of equine activities. By signing below, I fully understand that farms have risks. This release of liability includes boarded animals, animals here for training, hunters, all visitors, employees and contractors. Cathy’s Corral, Michael and Cathy Minix, their volunteers, and employees cannot be held liable or responsible for any accidents, injuries, loss of property, injuries to animals or vehicles.
